Downtown San Diego Litigation Update
As real estate agents, litigation is something that we have become very familiar with here in Downtown San Diego, but it can be something new for our clients who aren’t familiar with the term or the area. It is important to know because Litigation can limit a buyer’s options for financing, including FHA and VA lending options. Most lenders will require 20% down if the building is in Litigation. Most buildings will give you a minor summary of the litigation details but when purchasing a property, you will receive the HOA documents which will reveal all the current information and updates on litigation. The good news …. the number of buildings that are currently in litigation can almost be counted on just one hand. The following buildings in litigation are below:

Date originally filed: March 20th, 2015 – 1209 Days
Most recent update: There were motion hearings and attorney changes during the month of June.
Future events: Motion hearings set for August 17th and 24th.
Litigation Status: Pending
Date originally filed: December 16, 2015 – 938 Days
Most recent update: A hearing was rescheduled for April 13th.
Future events: On July 13th there was a civil case management conference.
Litigation Status: Closed
Date originally filed: May 6th, 2013 – 1892 Days
Most recent update: All claims have been settled and court cases have been dismissed as of June 2019.
Litigation Status: Pending
Date originally filled: October 6th, 2017 – 278 Days.
Future events: On August 31st there is a Civil Case Mangement Conference scheduled.
Litigation Status: All proceedings stayed
Date originally filed: March 16th, 2015 – 1122 Days
Most recent update: On April 6th there was a status conference.
Future events: A status conference is scheduled for October 5th
Litigation Status: Trial Set
Date originally filed: May 17th, 2013 – 1881 Days
Most recent update: Cross complaints and notices of dismissals were filed in June. A civil court trial was on July 20th.
